Weddings & Events By Prestige HOPE pty ltd - trading as The Estate' and 'Townsville Event Co.' the terms and conditions herein apply across all trading entities
For the purpose of these terms and conditions, the following definitions apply:
‘Event Order’ means the board generated in Trello during styling meetings, you may request this be provided to you prior to your event stating all details of your function, otherwise please refer to your invoice for a detailed list.
‘Business Day’ means any day from Monday to Friday inclusive, except public holidays.
‘Resort’ means The Estate, its managers, supervisors and employees.
‘Resort’ does not suggest or describe the premises, merely a collective term for the property.
‘Resort Premises’ means the premises situated at The Estate, Majors Creek.
2.1 Your venue will be held tentatively for seven days, from the date the Resort accepts your booking, bookings are not finalised or secured until the retainer of date is paid and T&Cs returned signed and a copy of your CC supplied for damages.
2.2 The confirmation of your booking is required in writing to the Resort, and a retainer payment made (paragraph below) within seven days of making your booking. Payment of this is deemed acceptance of the “Terms and Conditions” herein.
2.3 The final payment to the Resort is required 28 clear Business Days before your function.
3.1 Should you need to change your booking date, the $500 retainer is non-transferrable and non-refundable, unless prior or special arrangement by owner or directors.
If the original booking date is resold to another wedding couple, your $500 retainer will be transferred to your new booking date.
4.1 A $500 non-refundable retainer is required within (7) days of booking. The retainer is to be paid with terms and conditions signed and returned before your booking is guaranteed. Tentative bookings without a retainer paid and terms and conditions signed will only be held for a period of (7) days. The Resort reserves the right to release any tentative bookings after the (7) days.
4.2The following payment schedule applies to all bookings:
4.3 12 months prior to your wedding date, 25% of your estimated wedding cost is required to be paid
4.4 6 months prior to your wedding date, 50% of your estimated wedding cost is required to be paid
4.5 3 months prior to your wedding date, 75% of your estimated wedding cost is required to be paid
4.6 14 days prior to your wedding date, 100% of your wedding cost is required to be paid.
5.1 The full payment of your invoiceis required at least (28 days) prior to your date. Services will not be provided without the final payment being received.
5.2 Any additional charges need to be settled on departure.
5.3 Your credit card details will be held on file for final settlement purposes. You will be notified regarding and charges processed on your credit card for any breakages, damages, or incidentals.
6.1 You are required to provide the Resort in writing particulars of all venues, beverages, entertainment, technical requirements, room set ups, starting, and finishing times in connection with your wedding. These details are required at least one month before your function.
6.2 The final attendance numbers must be notified to the Resort (28) days prior to your wedding. Any reduction in attendance numbers within (28 days) prior to your function will be subject to charging at the full contracted amount. Verbal discussions about numbers do not overrule what is written herein. If you do not have an agreement in writing, for a different arrangement, all numbers are final 28 days out.
Example: your approximate number of guests is 90 when confirming your booking, paying your deposit, and agreeing to the package’s minimum number, which may say 70. Then, (28) days from your wedding, when final numbers are required, only 60 guests can attend the event. You will be then charged for the 70 minimum as listed on your package. If you advise of final numbers and these change within the final month, full payment is still required.
6.3 The Estate is a private property open to other guests. All guests are required to observe house rules, trespass, noise (music is to be turned off strictly at 11pm, no noise is to be audible after this time, this includes shouting, singing etc) and general behaviour, particularly at night. Anyone in your party creating nuisance may be asked to leave the premises immediately and will be liable for any damages caused either to other guests or the proprietor. We do have a noise service charge if this is not adhered to.
7.1 All cancellations are required in writing.
7.2 All retainers are non-refundable.
7.3 Notice within 12 months of your wedding date, 25% of the wedding cost will be charged if not already paid.
7.4 Notice within 6 months of your wedding date, 50% of the wedding cost will be charged if not already paid.
7.5 Notice within 3 months of your wedding date, 75% of the wedding cost will be charged if not already paid.
7.6 Notice within 1 month of your wedding date, 100% of the wedding cost will be charged if not already paid.
8.1 The Estate is a very popular wedding and events venue, we highly recommend your guests book their accommodation as early as possible to avoid missing out.
8.2 Guest accommodation at The Estate is subject to availability and booked on the acceptance of our accommodation terms and conditions (available on www.tsveventco.com). All guest accommodation bookings require a 50% non-refundable retainer when the booking is made over the phone or via email. All guest accommodation bookings made online through the resort’s website require full payment upon reservation.
8.3 Check in is at 2.00pm (day of event) and check out is at 10.00am (day after event). Please ensure you take this into consideration when selecting your ceremony time as we cannot guarantee an early check in for your guests.
9.1 If the Resort is unable to provide the facilities or any other arrangements for your wedding or any part thereof, or to otherwise perform the terms of this agreement and the Resorts failure is due to circumstances beyond its decision or control, i.e an act of God, virus outbreak or terrorist situation, the Resort is not responsible for any costs, damages or expenses that you may suffer or incur.
9.2 The resort cannot guarantee the same coordinator throughout the planning process. In the result of a co-ordinator ceasing employment a new coordinator will be allocated at our discretion.
10.1 Your wedding must be conducted in an orderly and lawful manner.
10.2 The Resort may terminate your wedding if the Resort reasonably believes that your wedding is not being conducted in an orderly and lawful manner.
10.3 The Resort has no responsibility to you for any costs, damages, or expenses that you may incur in relation to the Resorts termination of your wedding.
10.4 The Resort may exclude or remove any persons or possessions from your wedding or from the Resort premises.
10.5 This Resort practices principles of responsible service of alcohol. The Resort reserves the right to refuse service and/or exclude any guest from the function or from the premises if the client is aggressive, destructive, or intoxicated.
11.1 You are responsible for all loss and damage to the property of the Resort (including the Resort Premises and any fixtures, furnishings, or goods on or off the Resort) caused by or arising from any act or omission by you, your guests or any other persons attending your wedding or present in the Resort rooms.
11.2 The Resort will take the most extreme care, but no responsibility will be taken for any loss or damage to persons, guests, other vendors, merchandise, decorations, cakes, or any personal property prior to, during or after weddings. By hiring ‘The Estate’ farm stay, you acknowledge this is private farm stay property and could potentially have any hazards of a standard rural property, for example snakes and wild animals.
11.3 You must ensure that nothing is nailed, screwed, or adhered in any way to any wall, door or other part of the building unless prior permission is granted by the Resort.
12.1 We are happy to organise special meals for guests with dietary requirements and we ask for notification of these dietary requirements at the scheduled 21 days meeting.
13.1 Unfortunately, we are unable to offer food tastings, however you are welcome to dine in our restaurant, the food is similar and prepared by our chef who also does the weddings.
14.1 We offer children’s meals, dependent on catering package selected. Please note no alcohol is to be served to these minors.
15.1 Please organise these with your caterers or advise if booking catering through Weddings & Events By Prestige HOPE
16.1 No drinks of any kind are to be brought into our ceremony and receptions venues, if licensed by the Resort
16.2 RSA laws apply and will be honoured as is our duty under Queensland Licensing Laws.
16.3 No minors will be served.
16.4 Drinks prices are fixed 21 days prior to your wedding. Bar tab or cash bar options will be available during or after the bar tab or package duration.
17.1 Our music system is including for pre-dinner drinks & canapes, however it is not designed for the dancing part of your wedding. We recommend professional entertainment companies for reception music.
18.1 Please discuss this with your wedding coordinator at least 1 month prior to your wedding.
19.1 The Resort makes equipment, furniture, and decorations available to you, however some advertised equipment might be unusable due to repair or replacement. In these cases, the Resort will provide suitable alternative substitute equipment.
20.1 Please discuss with your wedding coordinator if you would like to extend the reception venue hire, as the Resort would not be able to arrange this on the day.
20.2 A 15% surcharge is applicable to the total food and beverage account for wedding held on Public Holidays.
21.1 Where goods or services are supplied from an external supplier additional terms and conditions may apply, such as additional deposits, earlier confirmation of final numbers or cancellation fees. You are responsible for any fees that may apply in relation to the supplier’s terms and conditions.
21.2 Prestige Group NQ acts as an agent for external suppliers, such as Photography and Videography, Decorators, Cake Supplier, and others, therefore the suppliers hold all responsibility for their services.
22.1 Any items that have not been collected after the event will be disposed of within (7) days.
23.1 Theft, damage, or loss of any goods brought onto the Resort Premises
23.2 Any introduction of food to the wedding and the effect of thereafter.
24.1 The Resort may assign you to another area or room for your wedding in the event that the area or room originally designated for your wedding is unavailable for any reason or the Resort believes the area of the Resort originally designated for your function is deemed inappropriate.
24.2 Options for wet weather reception venue change will be a community run venue, depending totally on which is available on the wedding day. The decision to move the reception venue in the event of wet weather is the responsibility of the bride and groom based on advice from Prestige Group NQ. However, Prestige Group NQ reserves the right to overrule the bride and groom’s decision if necessary. The decision must be made no later than 8.00am on the day before your wedding. In the event you choose to hold your wedding on The Estate and the weather becomes inclement prior to the commencement or during your reception and you request Prestige Group NQ to move to another venue, a fee of $1500 including GST will be charged. Should you choose to proceed with the The Estate during forecasted wet weather, a waiver will be required to be sign on the morning of the wedding to release Prestige Group NQ, Weddings & Events By Prestige HOPE pty ltd, from liability of you and your guests ‘safety.
25.1 All confetti are prohibited.
25.2 Bubbles and petals are the exception, please discuss this with your wedding coordinator prior to the event.
25.3 No metal cut sprinkles, crystals, glitter allowed (including on tables for your reception).
26.1 The Resort reserves the right to use any image or video taken from the event, for the purpose of any legitimate advertising or marketing activities for the Resort to use in any media type including internet, newspaper, and television.
27.1 Whilst every effort is made to maintain prices as printed or quoted, they may be subject to increase without notice to cover unforeseen price rises. Please note: each package is increased on January 1 each year.
27.2 If your wedding date is changed to the next year for any reason, the new wedding package prices and venue hire fees will apply.

In paying the booking deposit, these terms and conditions are binding upon the client.

TERMS & CONDITIONS HIRE ITEMS
The “Owner” is Weddings & Events By Prestige HOPE pty ltd.
The “Hirer” refers to the person, firm or corporation hiring equipment from the Owner.
The “Equipment” means all the equipment and accessories supplied to the Hirer.
“Terms” means these Terms and Conditions of Hire.
These are based on a 1 day period. Extended hire periods can be arranged in the original booking of the Hirer and will depend on the availability of Equipment. Weddings & Events By Prestige HOPE pty ltd will provide a quote for an extended hire period on the request of the Hirer.
A non-refundable retainer of 50% of the total hire/service cost is required to be paid to Weddings & Events By Prestige HOPE pty ltd to confirm the Hirer’s booking. Retainer paid will come off the total bill payable. Retainers are required for all orders, with the exception of:
Prices quoted are for delivery on street level. Extra charges may be payable for delivery to and removal from higher or lower level.
The total invoice must be paid 30 days before delivery or pickup of any Equipment. If the Hirer does not comply with this, Equipment will not be released and the deposit is non-refundable.
If the Hirer requests to have item/s removed from the invoice after the retainer is paid the 40% retainer is non-refundable nor transferable.
All prices are quoted in Australian Dollars and exclude GST.
A 15% surcharge will be incurred on public holidays.
Booking retainers paid are non-refundable to cancellation, change-of-mind or change of date. No refund applies to retainer amount, as this covers service and admin fees.
Any refunds will incur an administration fee of $95.00; your refund amount will be less this amount if a refund is eligible.
Cancellations are requested in writing by email or letter by the Hirer stated on the invoice and can be sent Weddings & Events By Prestige HOPE pty ltd, 807 Flinders Street, Townsville, QLD or via email to hire@prestigehope.com
Cancellations made more than 30 days from delivery will receive a refund of any funds remitted, excluding the booking deposit.
Cancellations made less than 30 days from delivery will receive a refund of delivery and collection fees only. The remainder of the bill must be paid in full as the cost of Equipment is considered cost of lost opportunity to Weddings & Events By Prestige HOPE pty ltd.
No refund applies for Equipment cancelled on delivery.
No refund applies to cancellations of Custom Built or Special Purchase Equipment and full payment must be paid by the Hirer.
Booking retainers are non-transferable.
All quotes provided expire within 7 calendar days. Weddings & Events By Prestige HOPE pty ltd reserves the right to adjust the prices in any quotation once the expiry period has been reached. Equipment is hired on a ‘first come, first served’ basis and a quotation does not guarantee the availability of any/all items.
Quoted prices are in relation to the ‘standard inclusions’ or ‘package inclusions’ listed on the specific package or property you have inquired about. Any additional elements or requirements are on an individual event basis and you must make your coordinator aware of your requirements, they will then advise if this is something we organise. The assumption of inclusions will not be entered into, if it is not listed, it is not included.
NOTE: All props are used and therefore reasonable signs of wear and tear will show as they are continual hire items.
The Hirer assumes all responsibility for the Equipment from the time of delivery until collection by Weddings & Events By Prestige HOPE pty ltd and is liable for all Equipment damaged or lost during this period. Insurance is not covered Weddings & Events By Prestige HOPE pty ltd once the Equipment has left the warehouse location.
The Hirer shall maintain at its expense liability, property and casualty insurance coverage in amount necessary to fully protect Weddings & Events By Prestige HOPE pty ltd Equipment against all claims, loss or damage of whatever nature or type.
Any Equipment used outside is done so entirely at the risk of the Hirer. In no case should the Equipment be used or left outside in the rain or overnight.
In no case should any furniture ( including dining chairs and lounge furniture) or floor coverings such as rugs be used on wet or muddy ground.
All items must be stored with covers provided when not in use, and left in secure dry storage.
Credit card details are required as a security bond from the Hirer and held in the case of any and all damages, breakages, theft or unaccounted Equipment from Weddings & Events By Prestige HOPE pty ltd.
Any charges made regarding damages, breakages, professional-cleaning costs, repairs or shortages the hirer will be invoiced accordingly and the relevant amount will be charged to the hirer’s nominated credit card.
Upholstered items and furniture that are returned dirty will be professionally cleaned at our warehouse this includes items returned with muddy marks, scuff marks and grass stains and an invoice will be issued to you and charged to the hirer’s credit card for payment.
For all chair cushions that are returned dirty, $2.00 per cushion is charge to clean.
If an item is returned damaged but repairable, you the Hirer will be sent an invoice for the cost of repairs and payment will be charged to the hirer’s credit card.
It is the responsibility of the Hirer to ensure all crockery and glassware is rinsed of food and drinks, and must be re-packaged exactly as delivered.
In the event that Weddings & Events By Prestige HOPE pty ltd is issued with a fine due to the instructions of the Hirer, the fine will be payable by the Hirer.
The Hirer agrees that all charges for hire loss, hire extension, damage and repair will be paid and that all collection fees, legal fees or any expenses involved in the collection of these charges will be paid by the Hirer.
There must be a site contact available at all times during the delivery and collection days to sign for both the delivery and collection. The Hirer must provide Weddings & Events By Prestige HOPE pty ltd with the name/s of this person/s and contact details. Drop off access must be arranged by the Hirers prior to driver arriving. Help may be required to lift furniture on arrival. Neither the delivery person or the stylist are capable of lifting on their own where furniture is involved.
All hire items must be packed up and stored in an accessible place ready for collection, if any items are not packed away and ready for pick up at the designated time and cause delay to our staff. Which then requires our staff to pack up items this will incur a fine of $500 which will be charged to the hirer’s designated credit card.
If Weddings & Events By Prestige HOPE pty ltd is setting up Equipment, the Hirer is responsible for allowing sufficient time and access to the venue for set-up. In this instance an additional charge will be included for set up based on hire quantity.
When Equipment is received, it is the responsibility of the Hirer to check the itemised receipt to confirm all Equipment has been delivered. If item/s are missing from the order and are shown on the receipt, it is the responsibility of the Hirer to inform The Wedding Shed immediately.

2.1 Your chosen venue will be held tentatively for seven days, from the date the Resort accepts your booking.
2.2 The confirmation of your booking is required in writing to the Resort, and a deposit payment made (paragraph below) within seven days of making your booking. If a signed copy of this “Terms and Conditions” document and a deposit are not received by the Resort within seven days, the venue will be released, and your booking may be cancelled. Exceptions and extensions may apply at management’s discretion.
2.3 The final payment to the Resort is required 14 clear Business Days before your function.
3.1 Should you need to change your booking date, the $500 retainer is non-transferrable and non-refundable.
If the original booking date is resold to another wedding couple, your $500 retainer will be transferred to your new booking date.

Should you choose to proceed with the Prestige Estate during forecasted wet weather, a waiver will be required to be sign on the morning of the wedding to release Prestige Group NQ, Weddings & Events By Prestige HOPE pty ltd, from liability of you and your guests ‘safety.
25.1 All confetti are prohibited.
25.2 Bubbles and petals are the exception, please discuss this with your wedding coordinator prior to the event.
25.3 No metal cut sprinkles, crystals, glitter allowed (including on tables for your reception).
26.1 The Resort reserves the right to use any image or video taken from the event, for the purpose of any legitimate advertising or marketing activities for the Resort to use in any media type including internet, newspaper, and television.
27.1 Whilst every effort is made to maintain prices as printed or quoted, they may be subject to increase without notice to cover unforeseen price rises. Please note: each package is increased on January 1 each year.
27.2 If your wedding date is changed to the next year for any reason, the new wedding package prices and venue hire fees will apply.

In paying the booking deposit, these terms and conditions are binding upon the client.

TERMS & CONDITIONS HIRE ITEMS
The “Owner” is Weddings & Events By Prestige HOPE pty ltd.
The “Hirer” refers to the person, firm or corporation hiring equipment from the Owner.
The “Equipment” means all the equipment and accessories supplied to the Hirer.
“Terms” means these Terms and Conditions of Hire.
These are based on a 1 day period. Extended hire periods can be arranged in the original booking of the Hirer and will depend on the availability of Equipment. Weddings & Events By Prestige HOPE pty ltd will provide a quote for an extended hire period on the request of the Hirer.
A non-refundable retainer of 50% of the total hire/service cost is required to be paid to Weddings & Events By Prestige HOPE pty ltd to confirm the Hirer’s booking. Retainer paid will come off the total bill payable. Retainers are required for all orders, with the exception of:
Prices quoted are for delivery on street level. Extra charges may be payable for delivery to and removal from higher or lower level.
The total invoice must be paid 30 days before delivery or pickup of any Equipment. If the Hirer does not comply with this, Equipment will not be released and the deposit is non-refundable.
If the Hirer requests to have item/s removed from the invoice after the retainer is paid the 40% retainer is non-refundable nor transferable.
All prices are quoted in Australian Dollars and include GST.
A 15% surcharge will be incurred on public holidays.
Booking retainers paid are non-refundable to cancellation, change-of-mind or change of date. No refund applies to retainer amount.
Any refunds will incur an administration fee of $95.00; your refund amount will be less this amount if a refund is eligible.
Cancellations are requested in writing by email or letter by the Hirer stated on the invoice and can be sent Weddings & Events By Prestige HOPE pty ltd, 807 Flinders Street, Townsville, QLD or via email to hire@prestigehope.com
Cancellations made more than 30 days from delivery will receive a refund of any funds remitted, excluding the booking deposit.
Cancellations made less than 30 days from delivery will receive a refund of delivery and collection fees only. The remainder of the bill must be paid in full as the cost of Equipment is considered cost of lost opportunity to Weddings & Events By Prestige HOPE pty ltd.
No refund applies for Equipment cancelled on delivery.
No refund applies to cancellations of Custom Built or Special Purchase Equipment and full payment must be paid by the Hirer.
Booking retainers are non-transferable.
All quotes provided expire within 7 calendar days. Weddings & Events By Prestige HOPE pty ltd reserves the right to adjust the prices in any quotation once the expiry period has been reached. Equipment is hired on a ‘first come, first served’ basis and a quotation does not guarantee the availability of any/all items.
NOTE: All props are used and therefore reasonable signs of wear and tear will show as they are continual hire items.
The Hirer assumes all responsibility for the Equipment from the time of delivery until collection by Weddings & Events By Prestige HOPE pty ltd and is liable for all Equipment damaged or lost during this period. Insurance is not covered Weddings & Events By Prestige HOPE pty ltd once the Equipment has left the warehouse location.
The Hirer shall maintain at its expense liability, property and casualty insurance coverage in amount necessary to fully protect Weddings & Events By Prestige HOPE pty ltd Equipment against all claims, loss or damage of whatever nature or type.
Any Equipment used outside is done so entirely at the risk of the Hirer. In no case should the Equipment be used or left outside in the rain or overnight.
In no case should any furniture ( including dining chairs and lounge furniture) or floor coverings such as rugs be used on wet or muddy ground.
All items must be stored with covers provided when not in use, and left in secure dry storage.
Credit card details are required as a security bond from the Hirer and held in the case of any and all damages, breakages, theft or unaccounted Equipment from Weddings & Events By Prestige HOPE pty ltd.
Any charges made regarding damages, breakages, professional-cleaning costs, repairs or shortages the hirer will be invoiced accordingly and the relevant amount will be charged to the hirer’s nominated credit card.
Upholstered items and furniture that are returned dirty will be professionally cleaned at our warehouse this includes items returned with muddy marks, scuff marks and grass stains and an invoice will be issued to you and charged to the hirer’s credit card for payment.
For all chair cushions that are returned dirty, $2.00 per cushion is charge to clean.
If an item is returned damaged but repairable, you the Hirer will be sent an invoice for the cost of repairs and payment will be charged to the hirer’s credit card.
It is the responsibility of the Hirer to ensure all crockery and glassware is rinsed of food and drinks, and must be re-packaged exactly as delivered.
In the event that Weddings & Events By Prestige HOPE pty ltd is issued with a fine due to the instructions of the Hirer, the fine will be payable by the Hirer.
The Hirer agrees that all charges for hire loss, hire extension, damage and repair will be paid and that all collection fees, legal fees or any expenses involved in the collection of these charges will be paid by the Hirer.
There must be a site contact available at all times during the delivery and collection days to sign for both the delivery and collection. The Hirer must provide Weddings & Events By Prestige HOPE pty ltd with the name/s of this person/s and contact details. Drop off access must be arranged by the Hirers prior to driver arriving. Help may be required to lift furniture on arrival. Neither the delivery person or the stylist are capable of lifting on their own where furniture is involved.
All hire items must be packed up and stored in an accessible place ready for collection, if any items are not packed away and ready for pick up at the designated time and cause delay to our staff. Which then requires our staff topack up items this will incur a fine of $500 which will be charged to the hirer’s designated credit card.
If Weddings & Events By Prestige HOPE pty ltd is setting up Equipment, the Hirer is responsible for allowing sufficient time and access to the venue for set-up. In this instance an additional charge will be included for set up based on hire quantity.
When Equipment is received, it is the responsibility of the Hirer to check the itemised receipt to confirm all Equipment has been delivered. If item/s are missing from the order and are shown on the receipt, it is the responsibility of the Hirer to inform The Wedding Shed immediately.
